Terms and conditions

The conditions related to sailing programs and membership fees are as described in the registration section of the Borealis Sailing Center (the Centre) website. The Centre is governed by its General Bylaws and by its Policies, Rules of operation and Emergency contingency plans aboard sailboats, as modified from time to time by the general assembly of members or by the board of directors of the Centre. By accepting the Terms and Conditions, you agree to respect the rules in force at all times in your interactions with the Centre.

Limitation of Liability

You hereby declare that you understand that activities organized by the Borealis Sailing Centre require a certain level of physical fitness, and that the activities may involve risk of injury, which could be potentially serious, and loss of personal property; that you are voluntarily participating in these activities with knowledge of the risks involved; and that you expressly assume and accept any and all risks.

You, and any other person representing you (i.e., parent or guardian of a person aged 12 to 17), hereby release the Centre and its officers and members, from responsibility for any and all liabilities, losses, injuries or expenses that may be sustained by you while participating in activities organized by the Centre.

If you invite a person, including a person who is not yet 18 years of age, who is not a member of the Centre to participate in any activity organised by the Centre, you are held responsible for that person and his/her actions; and you release the Centre from responsibility for any and all liabilities, losses, injuries or expenses that may be sustained by the guest. The guest will sign the waiver form intended for this purpose.

You agree to inform the skipper of any medical condition that could impact the activity.

You agree to keeping up to date your contact information and well as the information on the person to contact in case of emergency and his or her contact information.

Collection, Use and communication of Personal Information

The consent you give during your registration regarding the collection, use and communication of your personal information is an integral part of the Terms and Conditions.

Code of conduct for confidentiality and protection of personal information

You declare that you adhere to the code of conduct for confidentiality and protection of personal information adopted by the Centre and reproduced below:

This code of conduct targets all members and volunteers (in positions of responsibility or support) who participate in tasks (administrative or operational) for the Borealis Sailing Centre (the Centre).

In accordance with the Centre's policy on confidentiality and the protection of personal information and as stated in our general regulations "All members of the Centre who have access to confidential information due to their participation(s) in administrative or operational management tasks for the Centre must adhere to the following code of conduct:

  1. Minimum data collection: Collect only the personal information necessary for legitimate and specific purposes. Avoid collecting superfluous or irrelevant data for the intended purpose.
  2. Maintain all information of a personal, confidential or proprietary nature in complete confidence and confidentiality for the time necessary to fulfill the obligations to which a member is assigned. This information will only be used to fulfill the obligations of the assigned tasks; it will not be used for any other purpose or disclosed to a third party at any time in professional and social situations.
  3. Keep under his control or in his possession in a secure location, physically or electronically, only the information necessary to fulfill the obligations of the assigned task or position and protect this confidential information against any unauthorized use, reproduction or disclosure.
  4. Comply with privacy laws that apply to the collection, use and communication of personal information.
  5. Perform one’s duties honestly, with care and diligence.
  6. Inform the privacy officer or the person responsible for confidentiality and protection of personal information when there is suspicion of a violation of personal information or any incident (in the process of retention and handling of information) which could cause harm to the person(s) whose personal information is involved in this incident.
  7. Return (or eliminate if it is a copy) all personal information at the end of one’s mandate for a task or position.
  8. Respect the privacy of others by not disclosing personal information without their consent. Respect the obligation of confidentiality and non-disclosure of personal information and sensitive information once responsibilities have expired and tasks are completed, beyond the mandate that has been assumed.

Safe Sport

A safe sports environment allows all members and participants, regardless of their level, to have resources that create a pleasant, healthy, inclusive and safe environment. The Borealis Sailing Centre attaches great importance to this objective. The Centre has adopted the policy, rules and procedures regarding integrity protection as well as the code of conduct for a safe sporting environment as set out by the Fédération de voile du Québec (FVQ).

You declare that you have read FVQ’s policy, rules and procedures regarding the protection of integrity and the participant's code of conduct and adhere to its content. Please notre that any failure to comply with any of the obligations contained in the policy and its code of conduct is subject to sanction.
